Assisted Reproductive Technology (A.R.T.) Law

With the miracles of modern science, infertile couples and individuals can pursue their dreams of parenthood through third-party assisted reproductive technology such as egg donor arrangements, embryo donor arrangements (also known as “embryo adoption”), and/or through the use of a surrogate or gestational carrier.

From a legal aspect, assisted reproductive technology arrangements are unique.  The law in this field is relatively new and it is evolving rapidly.  There are few who regularly practice in this area. Accordingly, legal representation by an attorney who is knowledgeable and up to date on the developments in this area of law is an important consideration for all parties involved.

Whenever a third party (i.e. surrogate, egg donor, sperm donor, embryo donor) is involved in an assisted reproduction procedure, it is extremely important to have a contract. A properly drafted contract is designed to protect each party’s legal interests and to clearly set forth matters such as the parties’ respective rights, liabilities, obligations, and risks.

If you’re one of the many individuals or couples considering a third-party assisted reproductive arrangement, Lisa Hanson can help by drafting or reviewing contracts and agreements, evaluating insurance coverage issues, petitioning the court for pre-birth orders for prospective adoptive parents, and by otherwise providing legal evaluation and advice.
